Viarenty operates a matchmaking platform (directory) allowing vehicle rental professionals (hereinafter the "Rental Companies") to present their fleet to end users (hereinafter the "Customers"). The Platform provides search, comparison and contact tools.

Viarenty acts as a technical intermediary and content host within the meaning of Article 6-I-2 of the LCEN. Viarenty is not a party to any rental agreement entered into between a Customer and a Rental Company, does not rent any vehicle on its own behalf, and does not intervene in its performance.

The rental contractual relationship is formed exclusively and directly between the Customer and the Rental Company. Viarenty is neither the owner, lessor, insurer, nor a party to the rental agreement, does not collect the rental price or the security deposit, and does not guarantee the availability, condition, or insurance of the vehicles. Any dispute related to a rental is a matter solely between the Customer and the Rental Company.

These principles, as well as the details of each party's rights and obligations, are set out in our Terms of use and service (section "Customer–Rental Company relationship and absence of liability for rentals").

Each user agrees to use the Platform in accordance with its intended purpose, the law, and this legal notice. Rental Companies warrant that they hold all rights, authorizations, registrations, insurance, and permits necessary for their rental activity, and undertake to publish accurate, lawful and up-to-date information. Customers undertake to provide truthful information in their requests. Any fraudulent, misleading, infringing, defamatory use or use that infringes third-party rights is in particular prohibited.

Viarenty implements reasonable means to ensure the accessibility and proper functioning of the Site, without an obligation of result. Viarenty shall not be held liable for:

• interruptions, unavailability, slowdowns or malfunctions of the Site, in particular in the event of maintenance, network or technical provider failures, or force majeure;
• content published by users, Viarenty acting as a hosting provider; its liability may only be engaged under the conditions of Article 6 of the LCEN, after proper notification of clearly unlawful content and failure to promptly remove it;
• indirect damages (loss of business, revenue, opportunity, data or reputation) resulting from use or inability to use the Site.

In accordance with Article 6-I-5 of the LCEN, any clearly unlawful content may be reported to [abuse@viarenty.com], specifying: the date of the notification; the identity of the reporting party; a description and precise location of the content (URL); the legal grounds justifying removal. Any abusive notification may engage the liability of its author.

The Viarenty brand, logo, Site architecture, text, graphic interface, databases and source code are protected by intellectual property law and remain the exclusive property of the Publisher or its licensors. Vehicle photographs and descriptions are provided by Rental Companies, who warrant that they hold the rights to them. Any reproduction, representation, extraction or reuse, in whole or in part, without prior written authorization, is prohibited and may constitute infringement.

The processing of personal data carried out through the Platform is described in the Privacy policy. In accordance with the GDPR and the French Data Protection Act, the user has rights of access, rectification, erasure, objection, restriction and portability, as well as the right to lodge a complaint with the CNIL (www.cnil.fr). Cookie management is accessible at any time via the "Manage cookies" link in the footer.

The Site may contain links to third-party sites (in particular those of Rental Companies or payment providers). Viarenty exercises no control over these sites and disclaims all liability regarding their content, availability, or data practices.

This legal notice is governed by French law. Failing an amicable resolution, any dispute relating to its interpretation or performance will be brought before the competent courts under ordinary law rules. Consumers retain the right to bring proceedings before the court of their choice under the conditions provided by the French Consumer Code and the Code of Civil Procedure.

In accordance with Articles L.612-1 et seq. of the French Consumer Code, consumer Customers have the right to resort free of charge to a consumer mediator for the amicable resolution of a dispute with the Publisher.
